You deserve to be paid fairly, fully, and promptly for all the hours you work. Unfortunately, many companies illegally avoid paying workers for overtime and get free work out of their employees. Many employees are paid a salary, but should still be entitled to overtime for all hours worked in excess of 8 hours a day and 40 hours a week. Misclassifying employees and not properly paying overtime is wage theft.

Misclassification

California law is written to protect employees and insure that employees are paid for all hours worked. Many employers offer to pay employees a salary, but then claim that since the employee is receiving a salary they are not entitled to overtime pay or meal periods and rest breaks. Based on what your job duties and responsibilities are, and where you perform your job duties, you could be entitled to overtime pay for all hours worked in excess of 8 hours in a day or 40 hours a week.

Missed Meal Periods & Rest Breaks

Most employees are entitled to an uninterrupted meal period at least 30 minutes before the 5th hour of work and two 10-minute rest breaks during an eight hour shift. If you are not receiving your meal periods and rest breaks or asked to perform work during your breaks and meal periods, then your employer could be taking wages from you.

Minimum Wage

You are entitled to pay for all the time you perform work for or are under the control of your employer. You should never be asked to “work off the clock” or perform additional job duties before you clock in or after you clock out.

Equal Pay Act

The California Equal Pay Act prohibits an employer from paying any employees wage rates that are less than what it pays employees of the opposite sex, or of another race, or of another ethnicity for substantially similar work, when viewed as a composite of skill, effort, and responsibility, and performed under similar working conditions.
